What can be done when a condominium property manager fails to convene the general meeting required for its replacement?
This is one of the issues addressed by Frédéric Coppinger, partner at Coblence avocats, in an article published by Le Particulier on changing condominium property managers.
Where the property manager fails to act, the chair of the co-owners’ council may, under certain conditions, convene the general meeting directly. If this is not possible, different rules apply and may result in the appointment of an administrator by the president of the judicial court.
The procedure also requires compliance with the rules governing notice of the meeting and the inclusion of the relevant resolution on the agenda of the general meeting.
