Uber driver employment status: tougher criteria for reclassification

In an article published in Liaisons Sociales Quotidien (Lamy Liaisons), Laurent Guardelli and Myrtille Lapuelle, partners in the employment law department, discuss two rulings issued by the court of cassation on july 9, 2025, which dismissed requests to reclassify Uber drivers as employees.

This position breaks with the 2020 case law and marks a shift in how the subordination relationship is assessed: it can now only be established based on specific facts demonstrating an actual power of direction and control.

The rulings take into account recent contractual and legal developments, including the french mobility orientation law, and could influence the transposition, by 2026, of the european directive establishing a presumption of employee status for platform workers.
