Clay shrinkage and swelling: what can property owners do when their insurer refuses to cover the damage?

Frédéric Coppinger, partner at Coblence avocats, shares his insights in Les Echos on the steps that may be taken following an insurer’s refusal to cover the damage.

Where the expert appointed by the insurer concludes that clay shrinkage and swelling is not the cause of the damage, the property owner may challenge that assessment, provide additional evidence and commission an independent expert report.

If the disagreement persists, litigation may follow and can extend over several years. Frédéric Coppinger stresses the importance of devoting sufficient time to monitoring the case and regularly following up on it, in particular to preserve the available remedies within the applicable limitation periods.

This is all the more important as the damage may continue to develop throughout the proceedings.
